This applies inside Waukesha city limits. ZIP codes and mailing addresses can cross city lines, and nearby towns, villages, and counties have their own rules. HOA rules and leases can be stricter.

Before you apply

  • Register the premises with the Wisconsin Department of Agriculture, Trade and Consumer Protection (DATCP) under Wis. Admin. Code ATCP 17.02 before a permit is issued.
  • Submit enclosure plans and a site plan showing distances to property boundaries, structures on the premises, and structures on adjoining properties for Community Development approval.
  • Renters on non-owner-occupied single-family parcels need written consent from the parcel owner; duplex or multi-family parcels are only eligible if the parcel owner occupies one of the units.

Key rules

  • Only one permit may be issued per tax parcel.
  • Enclosures must provide at least 16 square feet per chicken (including coop area), and coops must provide at least 3 square feet per chicken.
  • Enclosures must be covered with solid material or hardware cloth; chicken wire is not permitted for enclosures.
  • Coops and runs must be in the rear yard and set back at least 25 feet from neighboring residential structures and lot lines per Waukesha Municipal Code Section 33.07.
  • Premises with a permit must remain available for inspection by the Community Development Department.
